Over the past decade, the number of clinical trials registered with the Food and Drug Administration has increased dramatically. The business of clinical research has become more diverse, involving academic institutions, clinician-researchers in community settings, pharmaceutical companies, and contract research organizations. This growth has been accompanied by increasing concerns about the ethical conduct of research. Much of this concern has been directed to procedural issues including institutional review board review, data monitoring, and informed consent forms. However, the protection of human (...) subjects cannot be achieved by relying solely on procedural safeguards. There are more nuanced issues related to recruitment and retention of subjects, and to the process of informed consent, that are generated during the interaction between study staff and subjects. It is only through an examination of these relationships that one can more fully define and understand the challenges of protecting subjects in research. (shrink)

Advances in genomics have led to calls for developing population-based preventive genomic sequencing programs with the goal of identifying genetic health risks in adults without known risk factors. One critical issue for minimizing the harms and maximizing the benefits of PGS is determining the kind and degree of control individuals should have over the generation, use, and handling of their genomic information. In this article we examine whether PGS programs should offer individuals the opportunity to selectively opt out of the (...) sequencing or analysis of specific genomic conditions or whether PGS should be implemented using an all-or-nothing panel approach. We conclude that any responsible scale-up of PGS will require a menu approach that may seem impractical to some, but that draws its justification from a rich mix of normative, legal, and practical considerations. Our aim in this article is to define the difficulties that clinical ethics services encounter when they are asked to demonstrate the value a clinical ethics service (CES) could and should have for an institution and those it serves. The topic emerged out of numerous related presentations at the Un- Conference hosted by the Cleveland Clinic in August 2018 that identified challenges of articulating the value of clinical ethics work for hospital administrators. After a review these talks, it was apparent (...) that the field of clinical ethics may be at a crisis of sorts due to increased pressure to provide explicit measures to healthcare institutions to concretely demonstrate that CESs make a valuable difference in healthcare delivery. In this article, we grapple with how to satisfy the need for demonstrable value in a field in which metrics alone may not capture the scope of clinical ethics practice. We suggest that capturing the value of a CES has been difficult because the benefits of ethics consultation may be overt or attributable to the CES, but are often hidden due to the systems-level and process-oriented nature of clinical ethics work. Part of the difficulty in demonstrating the value of CESs is capturing and conveying all of the ways the integration of a CES throughout an institution positively affects patients, families, visitors, healthcare professionals, administrators, and the institution itself. Our aim is to (1) elucidate the multifaceted value added by a CES, including value that tends to be hidden and (2) suggest how to demonstrate value to others in a way that is not simplistic or reductionistic. In the US, research payments are technically taxable income. This article argues that tax liability is a form of possible economic and legal risk of paid research participation. Findings are presented from empirical research on Phase I healthy volunteer trials. The article concludes by discussing the implications of these findings for the informed consent process, as well as for broader ethical issues in whether and how payments for research participation should be regulated.

This paper analyses the activities of five organizations shaping the debate over the global governance of genome editing in order to assess current approaches to public engagement (PE). We compare the recommendations of each group with its own practices. All recommend broad engagement with the general public, but their practices vary from expert-driven models dominated by scientists, experts, and civil society groups to citizen deliberation-driven models that feature bidirectional consultation with local citizens, as well as hybrid models that combine elements (...) of both approaches. Only one group practices PE that seeks community perspectives to advance equity. In most cases, PE does little more than record already well-known views held by the most vocal groups, and thus is unlikely to produce more just or equitable processes or policy outcomes. Our exploration of the strengths, weaknesses, and possibilities of current forms of PE suggests a need to rethink both “public” and “engagement.”. (shrink)

Background: A growing literature has raised—skeptically—the question of whether cutting-edge scientific research can identify and address broader ethical and policy considerations in real time. In genomics, the question is: Can ELSI contribute to genomics in real time, or will it be relegated to its historical role of after-the-fact outsider critique? We address this question against the background of a genomic screening project where we participated as embedded, real-time ELSI researchers and observers, from its initial design through its conclusion.Methods: As part (...) of the ELSI study design, the project included an ongoing reflexive ethnography in which the authors studied the process of its design and implementation. The authors were true participant observers, serving as members of various task-oriented groups while recording meetings and other events for ongoing qualitative analysis. We also conducted and analyzed interviews of multiple participants at the conclusion of the project.Results: Our real-time ELSI initiative had a mixed record of successes and challenges. If we define success as ELSI researchers having had an opportunity to participate fully in the project and to make the ELSI perspective heard, then our assessment is largely positive. If, however, we define successes as instances where real-time ELSI contributions changed the direction of the genomic or public health aspects of the GeneScreen project or, after careful deliberation, confirmed the appropriateness of the status quo, then we can identify only a few examples. While we had a seat at the table, we were, for the most part, tolerated guests.Conclusions: We conclude that there are significant barriers to real-time ELSI influence. The difficulty does not reside in any intended exclusion of an ELSI perspective, but in factors endemic to genomic research, including knowledge disparities, epistemological biases, and the pressures of time and money. The current ethical norms of genomic biobanking creating and maintaining large repositories of human DNA and/or associated data for biomedical research have generated criticism from every angle, at both the practical and theoretical levels. The traditional research model has involved investigators seeking biospecimens for specific purposes that they can describe and disclose to prospective subjects, from whom they can then seek informed consent. In the case of many biobanks, however, the institution that collects and maintains the biospecimens may not itself (...) be directly involved in research, instead banking the biospecimens and associated data for other researchers. Moreover, the future uses of biospecimens may be unknown, if not unknowable, at the time of collection. Biobanking may thus stretch the meanings of inform and consent to their breaking point: if you cannot inform subjects about what their biospecimens will be used for, what can they consent to? Given that informed consent by individual subjects is the ethical gold standard, the seeming dilution of the concept in the context of biobanking is a profound problem. (shrink)

Hospital systems commonly face the challenge of determining just ways to allocate scarce drugs during national shortages. There is no standardised approach of how this should be instituted, but principles of distributive justice are commonly used so that patients who are most likely to benefit from the drug receive it. As a result, clinical indications, in which the evidence for the drug is assumed to be established, are often prioritised over research use. In this manuscript, we present a case of (...) a phase II investigational trial of intravenous thiamine for delirium prevention in patients undergoing haematopoietic stem cell transplantation to emphasise several shortcomings in the overarching prioritisation of clinical over research uses of scarce drugs. Specifically, we present the following considerations: clinical use may not have stronger evidence than research use; a strong scientific rationale for research use may outweigh the claim for clinical indications in which there is weak evidence; treatment within the context of a clinical trial may be the standard of care; and research use may not only benefit patients receiving the treatment but also offers the prospect of improving future clinical care. In summary, we argue against allocation schemes that prohibit all research uses of scarce drugs and instead recommend that allocation schemes include a balanced approach that weighs risks and benefits of access to scarce drugs irrespective of the research versus clinical use designation. Research uses of human bodies maintained by mechanical ventilation after being declared dead by neurological criteria, were first published in the early 1980s with a renewed interest in research on the newly or nearly dead occurring in about last decade. While this type of research may take many different forms, recent technologic advances in genomic sequencing along with high hopes for genomic medicine, have inspired interest in genomic research with the newly dead. For example, the Genotype-Tissue Expression program through the (...) National Institutes of Health aims to collect large numbers of diverse human tissues with the eventual goal of elucidating the genetic bases of common diseases through a better understanding of the relationship between genetic variation and gene expression. The growing practice of returning individual results to research participants has revealed a variety of interpretations of the multiple and sometimes conflicting duties that researchers may owe to participants. One particularly difficult question is the nature and extent of a researcher’s duty to facilitate a participant’s follow-up clinical care by placing research results in the participant’s medical record. The question is especially difficult in the context of genomic research. Some recent genomic research studies — enrolling patients as participants — boldly (...) address the question with protocols dictating that researchers place research results directly into study participants’ existing medical records, without participant consent. Such privileging of researcher judgment over participant choice may be motivated by a desire to discharge a duty that researchers perceive themselves as owing to participants. However, the underlying ethical, professional, legal, and regulatory duties that would compel or justify this action have not been fully explored. (shrink)

Each of the action agenda papers deals with one of the four core elements of public health legal preparedness: laws and legal authorities; competency in using those laws; coordination of law-based public health actions; and information. Although the first human embryonic stem cells were produced in 1998, the direction of U.S. policy on stem cell research was set nearly 20 years earlier when the recommendations of a congressionally established Ethics Advisory Board were ignored by the Reagan administration. Thus began an unprecedented and unparalleled 30-year-long history of political intrusions in an area of scientific and biomedical research that has measurable impacts on the health of Americans. Driving these intrusions were religiously informed public policy positions that have (...) usually escaped critical ethical analysis. Here I record my own encounters with this history of intrusions and the thinking behind them.My most abrupt encounter with the politics of stem cell research occurred on September 6, 2006, at a hearing of the Senate Subcommittee on Labor, Health and Human Services and Related Agencies, chaired by Senator Arlen Specter. Just a week before, scientists at Advanced Cell Technology, a small Massachusetts biotech company, had published a paper in the journal Nature in which they described a method for extracting stem cells from early human embryos while leaving the embryos intact and viable. She had been publishing shorter fiction as well as articles (...) since 1919.1 Her lover, Bertrand Russell, had encouraged her writing career, assisting with the placement of her first short story in The English Review.2 He thought a writing career preferable to acting. Using the stage name “Colette O’Niel”, she had a successful career on the stage.3 The novel is a fictional account of the love affair between Russell and Colette.They appear as Gregory del Orellano and Konradin Waring. It was not, however, recognized as a roman à clef when it was published, as their affair was not known by anyone except their closest friends and family members. John Slater recognized it for what it was.4 Three of the four Russell biographers mention the novel.5 Presumably all three relied on Slater’s article. Ronald Clark quotes one sentence from the novel, a summation of Gregory’s character by one of the other characters who shared the view of many. Gregory was seen as “a man exhausting other men by his intellect; exhausting women by his intensity; wearing out his friends, sucking them dry, passing from person to person, never giving any real happiness—or finding any” (Coming Back, p. 307; Clark, p. 583). Only Ray Monk undertakes a detailed description of the novel, even naming the last chapter of The Spirit of Solitude, “The Coming Back”. He identifies, as did Slater, several other characters with their real life counterparts: Ottoline Morrell is Magdalena de Santa Segunda; T. C. Maynard is T. S. Eliot; Jevons is Clifford Allen; Marcus Beazley is Maurice Elvey; Gertrude West is Dora Black. He quotes the sentence that Clark had used earlier (Monk 1: 607). Monk writes that “Russell claimed never to have read The Coming Back (or any of Colette’s other books). Perhaps he knew it would make painful reading” (1: 608). Monk provides no source for this judgment, and in fact it is untrue. Although The Coming Back is not specifically discussed in their correspondence, her other three books are.6 My reading of the novel is coloured by an attempt to identify what is true in the novel. My knowledge of the truth is based on editing their correspondence.The novel is a fascinating portrait of the Russell and Colette relationship, far more revealing to those in the know than her autobiographies, where libel concerns were always at the forefront. Her first autobiography, AfterTenYears, had been published two years earlier, in 1931, to great acclaim. The Coming Back’s dust-jacket reads: Here is the first novel from the author of that vivid and successful autobiography, After Ten Years. And as might be expected, it shows the same vitality, integrity, and the same passion for beauty as the earlier work. Constance Malleson presents a portrait of a young girl of our times, and of her stand for freedom, through all its stages from selfishness to a fine renunciation. Arnold Burms: Professor Williams has said that he is willing to answer some of our questions about his work. Given the amount of work he has to do here in a few days, this was a generous decision for which we are genuinely grateful. Professor Van de Putte will start the discussion with some questions about the relation between theory and practice.André Van de Putte: In Ethics and the Limits of Philosophy you situate ethical thought in the context of a (...) movement of reflection. To quote from page 112: “It is too late at this stage to raise the prior question: `Why reflection?' — too late in terms of this inquiry, and always too late in terms of the question itself, since one could answer it without prejudice only by not considering it.” And just before that quotation you also said that “the drive to theory has roots in ethical thought itself” and a little bit further you say: “The important question at this point is why reflection should be taken to require theory.” Now I would like to elaborate a little bit on these remarks and ask you to comment on what I'm going to say.Three things should be stressed concerning ethical reflection which are important for moral philosophy and for our understanding of moral philosophy. The first one is this: the person who is reflecting is already part of a concrete society when he or she starts reflecting. That means that he or she has been socialized in a concrete ethos and has already an experience of a substantive ethical life. In this sense he or she does not need to invent ethical life.The second remark is this: ethical reflection is in itself already the expression of an ethical intention. By asking the question `How should one live?', one shows that one is interested in living an ethical life. In this sense I can agree with what I think you say in Ethics, namely that the question `Why should I be moral?' is not meaningful for a moral thinker. The answer to the moral question, the results of his reflection are not meant to convince him or his readers to be moral. On the contrary, he starts precisely from this interest in morality and tries to understand what it means to be moral, what his wish to be moral implies.My third point is the most important. In starting his reflection the thinker has as it were decided that his answer will only be acceptable if it is valid for all, if it can be justified for all. In the moral question itself, a norm of universality is implied. And given the fact that the moral question is itself the expression of an ethical intention, this is important. If he would not assume this norm, he would in my view not really be posing the question. We can immediately understand this if we consider the alternative.Suppose a moral thinker who assumes that an answer to the moral question will be valid only when it suits him. Would we say in this case that this person is really asking the moral question? I do not think so. To put this another way, my thesis is that in the reflection the person who reflects is subjecting himself to the law of thinking itself, to the law of reason, in other words, to the law of universality, of non-contradiction. In the question he discovers this law as a norm for himself asking the moral question and thus as a norm inherent in moral intention. I think that this is precisely what Kant discovered and why for so many there is an important link between ethics and reason and why we are, as you say, driven to theory: since we want a universal answer, since a moral norm implies universality, we are looking for a theory, for a universal justification. But this is not yet the full story. All that I have said only becomes visible on the reflective level. It is only visible, as it were, once one starts reflecting.This means that the norm of universality cannot and must not be understood as a concrete norm which can and should replace the norms of the concrete ethos we all already live in when we start reflecting. I think rationalism in ethics is precisely that: the belief that this norm and what one hopes to deduce from it can and should replace the concrete ethos. I think it must be clear that this cannot be done. As we all know the Kantian imperative is formal and negative and does not produce any content. Richard Rempel is pu~suing the elusive tracks of Russell as ghost-writer, Research Associate Mark Lippincott is deciphering some manuscripts and our typesetter, Arlene Duncan, is keying in new texts for Volume 4. Albert Lewis vigilant-' Iy works daily on the computer, and over in the Russell Archives Ken Blackwell, (...) with the assistance ofSheila Turcon, continues to sleuth out new Russell writings, which we accept eagerly and appreciatively. In the age of the wordprocessor, silence has replaced the clacking of typewriters and the din of machinery. Silence signifies that there are people hard at work. Indeed we are! 1990 will be an important year. Volume 2, Philosophical Papers, 1896-99 (editedby Nicholas Griffin and Albert Lewis) has reached the publisher; we plan to have the first volume of the Bibliography (by Kenneth Blackwell and Harry Ruja) and Volume 6, Logical andPhilosophical Papers, 1909-13 (edited by John Slater) there by the end of the year; and Volume 3, Toward the "Principles", 1900-02 (edited by Gregory Moore), will not be far behind in 1991. Also in 1991 Volume 14, Pacifism and Revolution, 1916-18 (edited by L. Greenspan and R.A. Rempel with M. Lippincott) will be ready, and Volume 4, Foundations ofLogic, 190205 (edited by Alasdair Urquhart) will be coming to the home stretch. We will soon be working as quickly as Russell did! There are problems. In an age when even the Pentagon is suffering from cutbacks, so are we. The copy must be prepared by one typesetter who also acts as the Project secretary. That one person is handling a load that had previously been handled by three. Our university, like most others, is slashing budgets so that it has been forced to reduce its contributions to our funding. While we remain relatively fortunate in our level of university support, we in the Project have had to tighten our already taut belts even more. McMaster's budget cuts could mean that we cannot hire summer students for our research. This loss would be difficult but bearable. Next year some of the grants will run out. Then we will be even more dependent on a university, like others in Ontario, which is retrenching through a hiring 96 Russell summer 1990 freeze and other mortifications. Fortunately our May 1989 grants from the Social Sciences and Humanities Research Council of Canada remain unchanged. But the Russell Project has demonstrated that it is a hardy survivor. In the past we have endured cuts from S.S.H.R.C.C. and cutbacks from the university. But we have persevered and certainly accelerated our output significantly as our understanding of this massive enterprise has continued to develop. Integral Science provides the empirical rigor needed to shift medicine's worldview. The shift in science will give rise to Integral Medicine, which will emerge from the integration and transformational change of biomedicine, psychosocial approaches, Complementary and Alternative Medicine, and other reform movements. The root metaphor of Integral Medicine is a healthy and sustainable ecosystem. At its heart are mind-body holism and collaborative learning.
